Clause library
Plain-English readings of clauses that show up in Indian appointment letters. Not legal advice.
Read the clause you actually signed. These notes are a map, not your contract.
Notice
90-day notice
No Indian statute requires 90 days for typical IT/managerial roles. It is contractual. Long notice makes you harder to hire next time. Ask for a buyout formula in writing.
Notice
Salary in lieu of notice
Ordinary Indian letters let either side pay unserved notice. That is not a scam deposit. Switch Karle’s notice-buyout tool estimates the cash using the letter’s /30 convention.
Bond
Training / service bond
A rupee figure is not automatically payable. Courts have looked for specialised training cost and actual loss. Paste the clause into the bond scanner.
Variable
Variable at company discretion
If payout is “at discretion”, the CTC headline is not a promise. Use the variable-reality tool at 0 / 50 / 100%.
PF
PF transfer on exit
Transfer (Form 13) is the switcher’s move. Withdrawing before five years of continuous service can be a taxable premature withdrawal — see EPF transfer.
Probation
Probation then confirmation
Confirmation is often “subject to performance” with an extendable probation. Get the maximum length in writing so the date cannot slide forever.
Estimate, not tax or legal advice. FY 2026-27 rules. Your payroll’s exact structure will differ a little.
